Moolenaar Votes to Protect Due Process Rights of American Citizens
Today, House Democrats passed legislation that allows federal judges to confiscate an American citizen's guns without due process or advanced notice. Congressman John Moolenaar voted against the bill.
"Due-process is a vital right enjoyed by every American, and no citizen should have that taken away. I voted against this bill because it would allow a judge to take someone's firearms from them for 14 days without an opportunity for the accused to legally defend themselves," said Congressman John Moolenaar. "The Constitution is the cornerstone of our nation's success and we must respect the rights it gives to individuals."
The legislation allows a family member or roommate to request a federal order from a judge to confiscate another individual's firearm if the petitioner believes the person is a danger to themselves or others. The petitioner only has to demonstrate "probable cause" for the gun to be taken away and the individual is not allowed to defend themselves in court.
